Time Warner Cable&lt;/font&gt;&lt;/a&gt;&lt;font size=&quot;3&quot;&gt;&lt;font face=&quot;Times New Roman&quot;&gt;, the Federal Circuit confirmed that the standard for evaluating the adequacy of complaints alleging direct patent infringement remains Form 18 of the Appendix of Forms to the Federal Rules of Civil Procedure (&amp;quot;Form 18&amp;quot;).&lt;span&gt;&amp;nbsp; &lt;/span&gt;K-Tech filed separate complaints against Direct TV and Time Warner Cable (&amp;ldquo;TWC&amp;rdquo;) on the same day, alleging infringement of four patents.&lt;span&gt;&amp;nbsp; &lt;/span&gt;Direct TV and TWC each moved to dismiss under Federal Rule of Civil Procedure 12(b)(6), asserting the complaint, as filed, lacked sufficient factual specificity to state a cause of action for direct patent infringement.&lt;span&gt;&amp;nbsp; &lt;/span&gt;K-Tech sought, and was grated, leave to amend the complaints.&lt;span&gt;&amp;nbsp; &lt;/span&gt;After K-Tech filed its amended complaints, TWC and Direct TV again moved to dismiss under 12(b)(6).&lt;span&gt;&amp;nbsp; &lt;/span&gt;The district court granted the motions to dismiss, stating that the amended complaints failed to cure the defects with the original complaint, namely that the complaints did not explain why K-Tech believed the defendants were utilizing the methods and products protected by the asserted patents, rather than using other noninfringing methods and products, and therefore failed to meet the standards articulated in &lt;em&gt;Bell Atl. Corp. v. Twombly&lt;/em&gt;, 550 U.S. 544 (2007) and &lt;em&gt;Ashcroft v. Iqbal&lt;/em&gt;, 129 S. Ct. 1937 (2009).&lt;span&gt;&amp;nbsp; &lt;/span&gt;K-Tech appealed the dismissal two weeks before the Federal Circuit issued its decision in &lt;em&gt;R+L Carriers, Inc. v. DriverTech LLC (In re Bill of Lading Transmission &amp;amp; Processing System Patent Litigation)&lt;/em&gt;, 681 F.3d 1323 (Fed. Cir. 2012). The Federal Circuit consolidated the appeals. &lt;/font&gt;&lt;/font&gt;&lt;/p&gt;&lt;font face=&quot;Times New Roman&quot; size=&quot;3&quot;&gt;  &lt;/font&gt;&lt;font face=&quot;Times New Roman&quot; size=&quot;3&quot;&gt;  &lt;/font&gt;&lt;p style=&quot;margin: 0in 0in 0pt 0.25in&quot; class=&quot;MsoNormal&quot;&gt;&lt;font size=&quot;3&quot;&gt;&lt;font face=&quot;Times New Roman&quot;&gt;On appeal, K-Tech argued that the amended complaints complied with Form 18 and that the district court applied the incorrect standard.&lt;span&gt;&amp;nbsp; &lt;/span&gt;The defendants argued that sufficiency with respect to Form 18 must be interpreted in light of &lt;em&gt;Twombly&lt;/em&gt; and &lt;em&gt;Iqbal&lt;/em&gt;, and Ninth Circuit law, and that the amended complaints failed to meet either the plain language of Form 18 or the requirements of &lt;em&gt;Twombly&lt;/em&gt; and&lt;em&gt; Iqbal&lt;/em&gt;.&lt;span&gt;&amp;nbsp; &lt;/span&gt;The court relied on its recent decision in &lt;em&gt;R+L Carriers&lt;/em&gt; in reasserting the sufficiency of Form 18 for pleading patent infringement, and that to the extent any conflict exists between Form 18 and &lt;em&gt;Twombly&lt;/em&gt;/&lt;em&gt;Iqbal&lt;/em&gt;, the form controls.&lt;span&gt;&amp;nbsp; &lt;/span&gt;Because Form 18 does not include any indication that a patent holder must explain why it believes that a defendant is utilizing the methods and products protected by the asserted patents, rather than using other noninfringing methods and products, such assertions are not required to survive a motion to dismiss.&lt;span&gt;&amp;nbsp; &lt;/span&gt;Further, the court held that the failure of K-Tech to identify a particular allegedly infringing device or devices&amp;mdash;by name, model number, or otherwise&amp;mdash;did not bar K-Tech from filing a complaint in accordance with Form 18, stating, &amp;ldquo;A defendant cannot shield itself from a complaint for direct infringement by operating in such secrecy that the filing of a complaint itself is impossible. &lt;/span&gt;The Federal Circuit also reversed the district court&amp;rsquo;s granting of a motion under Federal Rule of Civil Procedure 60(b) filed by Photoscribe that vacated the district court&amp;rsquo;s prior judgment finding the same claims not invalid.&lt;span&gt;&amp;nbsp; &lt;/span&gt;LK sued Photoscribe alleging infringement of Lazare Kaplan&amp;rsquo;s patent covering systems and methods for microinscribing gemstones.&lt;span&gt;&amp;nbsp; &lt;/span&gt;In the ensuing trial, the asserted claims of the LK patent were adjudged not invalid and not infringed, either literally or under the doctrine of equivalents.&lt;span&gt;&amp;nbsp; &lt;/span&gt;&lt;span&gt;LK appealed the judgment of noninfringement, but Photoscribe did not appeal the judgment that the asserted claims were not invalid.&lt;span&gt;&amp;nbsp; &lt;/span&gt;On appeal, the Federal Circuit vacated the judgment as based on erroneous claim construction and remanded the case.&lt;span&gt;&amp;nbsp; &lt;/span&gt;On remand, the district court retried both the invalidity and infringement issues, and granted Photoscribe&amp;rsquo;s motions for summary judgment of invalidity and for relief from the prior judgment under Rule 60(b) while denying LK&amp;rsquo;s motion for summary judgment of infringement.&lt;span&gt;&amp;nbsp; &lt;/span&gt;Plaintiff alleged that two of Brilliant&amp;rsquo;s products infringed its patents.&lt;span&gt;&amp;nbsp; &lt;/span&gt;The district court granted summary judgment of non-infringement GuideTech argued that the district court erred in concluding no genuine issue of material fact existed with respect to infringement of the three patents, particularly in light of GuideTech&amp;rsquo;s expert reports describing the defendant&amp;rsquo;s products and delineating a theory of literal infringement and infringement under the doctrine of equivalents. &lt;span&gt;&amp;nbsp;&lt;/span&gt;Ultimately, the Federal Circuit concluded that the evidence, particularly the expert reports, provided a sufficient basis for a genuine issue of material fact.&lt;/span&gt;&lt;/li&gt;&lt;li&gt;&lt;!--[if gte mso 9]&gt;&lt;xml&gt; 				&lt;p&gt;In a decision Friday, the &lt;a href=&quot;http://www.cafc.uscourts.gov/&quot; title=&quot;United States Court of Appeals for the Federal Circuit&quot;&gt;Federal Circuit&lt;/a&gt;  affirmed a district court&amp;#39;s grant of summary of no literal infringement and that prosecution history estoppel barred application of the doctrine of equivalents.&amp;nbsp; During prosecution of the patent, a total of three limitations from two different dependent claims were added to the asserted claim in separate amendments, although only two of the limitations were addressed by the applicant and examiner.&amp;nbsp; The district court held the third element was not literally present in the accused product, and, based on the amendment, could not be present under the doctrine of equivalents.&lt;/p&gt;&lt;p&gt;The Federal Circuit agreed.&amp;nbsp; The court held it was immaterial that the first amendment (with the &amp;quot;extra&amp;quot; limitation at issue) did not result in allowance; the estoppel applied to each of the added limitations.&amp;nbsp; Importantly, the court also observed that this presumption of estoppel applied to &lt;u&gt;all&lt;/u&gt; claims of the patent containing the limitation, whether or not they were amended:&lt;/p&gt;&lt;blockquote&gt;&lt;p&gt;Thus, in this case, the cancellation of original independent claim 1 coupled with the rewriting of original dependent claim 7 as independent claim 14 gave rise to a presumption of surrender &lt;u&gt;&lt;strong&gt;applicable to all limitations&lt;/strong&gt;&lt;/u&gt;, found &lt;u&gt;&lt;strong&gt;in any of the claims&lt;/strong&gt;&lt;/u&gt; of the &amp;#39;625 patent, &lt;u&gt;&lt;strong&gt;that correspond to the limitations of claim 7&lt;/strong&gt;&lt;/u&gt;. &lt;/p&gt;&lt;/blockquote&gt;&lt;p&gt;The court also held that even though the third limitation was not specifically argued, its addition was not tangential to the rationale underlying the amendment, thereby preventing application of prosecution history estoppel.&amp;nbsp; Specifically, the amendment stated one of the two limitations was not present in the prior art, but added the limitation was not present &amp;quot;in combination with the other structure&amp;quot; of the claims.&amp;nbsp; This additional language brought the additional limitation into the argument, making it not tangential.&amp;nbsp; Further, the court held the absence of explanation why the additional limitation was added meant it could not be tangential, because whether an amendment is tangential must be determined from the prosecution record.&amp;nbsp; Accordingly, the court affirmed the district court&amp;#39;s grant of summary judgment of noninfringement.&lt;/p&gt;&lt;p&gt;More detail of &lt;em&gt;Felix v. Essentially, the method takes an otherwise ambiguous input and compares it to a &amp;quot;vocabulary&amp;quot; of possible words.&amp;nbsp; The system can also minimize memory requirements and enable an expanded word recognition capability by using a &amp;quot;vocabulary&amp;quot; of syllabic elements instead of words. &amp;nbsp;&lt;br /&gt;&lt;br /&gt;The relevant claim is claim 10, which is reproduced below (emphasis added):&lt;br /&gt;&lt;blockquote&gt;10.&amp;nbsp; A method of communicating, utilizing a signal-generating keyboard where at least some of the keys represent two or more alphabetic characters, comprising the steps of: &lt;br /&gt;inputting a word into said keyboard by depressing a single key for each&lt;br /&gt;alphabetic character of said word; &lt;br /&gt;transmitting signals generated by the key depressions; &lt;br /&gt;receiving said transmitted signals and decoding the signals into binary code; &lt;br /&gt;matching said binary code with one or more pre-programmed codes, &lt;u&gt;&lt;strong&gt;each pre-programmed code being representative of a syllabic element&lt;/strong&gt;&lt;/u&gt;; &lt;br /&gt;[f]orming a representation of the word from the one or more syllabic elements represented by the matched one or more pre-programmed codes; and &lt;br /&gt;outputting the word representation in a form perceptible to the user. &lt;br /&gt;&lt;/blockquote&gt;A prior art publication taught a system where a single key is pressed for each letter, even though the key corresponds to multiple letters.&amp;nbsp; During prosecution of the patent, the patentee obtained allowance of the claims over this reference by arguing the &amp;quot;invention employs a data base of syllabic elements (i.e. syllable-like letter groups) which are combined to form a word of standard English text.&amp;quot;&lt;br /&gt;&lt;br /&gt;Texas sued 56 defendants for infringing claim 10.&amp;nbsp; After a Markman hearing, the district court construed the term &amp;quot;syllabic element&amp;quot; to mean &amp;quot;a one-syllable letter group that either comprises a word or can be combined with other one-syllable letter groups to form a word.&amp;quot;&amp;nbsp; The district court concluded the term &amp;quot;one or more pre-programmed codes&amp;quot; did not require construction. &amp;nbsp;&lt;br /&gt;&lt;br /&gt;One defendant, Motorola, filed a motion for summary judgment of noninfringement on the basis that its accused devices did not infringe the &amp;quot;matching&amp;quot; limitation of claim 10, specifically because its &amp;quot;pre-programmed codes&amp;quot; were not all representative of syllabic elements, but instead corresponded to words.&amp;nbsp; The district court granted Motorola&amp;#39;s motion, and noted the plain language of claim 10 and the prosecution history required that each time a binary code is matched, it must be matched against a syllabic element.&amp;nbsp; The district court further reasoned that if it were to adopt the plaintiff&amp;#39;s argument that the accused devices &amp;quot;intermittently infringe&amp;quot; when they do match against a syllabic element, then a prior art reference would anticipate the claim.&amp;nbsp; After summary judgment was granted to Motorola, the parties stipulated to judgment of noninfringement for all remaining defendants based on the district court&amp;#39;s construction.&amp;nbsp; Texas appealed.&lt;br /&gt;&lt;br /&gt;The Federal Circuit affirmed.&amp;nbsp; Regarding the claim construction of &amp;quot;syllabic element,&amp;quot; the court reviewed the language of claim 10 and, based on the language of the claim, a word is comprised of one or more &amp;quot;syllabic elements.&amp;quot;&amp;nbsp; The court then turned to the specification which repeatedly distinguished between a &amp;quot;word&amp;quot; and a &amp;quot;syllabic element,&amp;quot; further indicating that a word is comprised of syllabic elements, and that the terms &amp;quot;word&amp;quot; and &amp;quot;syllabic element&amp;quot; are not coextensive in scope.&amp;nbsp; The Federal Circuit finally turned to the prosecution history, and noted &amp;quot;syllabic element&amp;quot; was added to claim 10 to overcome prior art describing using words for the same purpose, and that if &amp;quot;syllabic elements&amp;quot; included words then that portion of the claim would have been anticipated by the same piece of prior art.&amp;nbsp; Therefore the Federal Circuit affirmed the district court&amp;#39;s construction of &amp;quot;syllabic element.&amp;quot;&lt;br /&gt;&lt;br /&gt;Regarding the claim construction of &amp;quot;each pre-programmed code being representative of a syllabic element,&amp;quot; the Federal Circuit noted that the district court granted summary judgment of non-infringement in favor of Motorola on the ground that the accused devices did not rely upon a vocabulary of only syllabic elements.&amp;nbsp; The plaintiff argued that infringement occurs whenever a match with a match with a syllabic element occurs, even if matches are also made with non-syllabic elements. &lt;br /&gt;&lt;br /&gt;The Federal Circuit again agreed with the district court.&amp;nbsp; Because the claim and the prosecution history distinguished between &amp;quot;each pre-programmed code&amp;quot; and &amp;quot;the matched one or more pre-programmed codes, the Federal Circuit concluded that the claim phrase &amp;quot;each pre-programmed code being representative of a syllabic element&amp;quot; means that the vocabulary only includes syllabic elements.&amp;nbsp; The fact that the claim used the open transitional phrase &amp;quot;comprising&amp;quot; did not change the result.&amp;nbsp; The effect of comprising is to not exclude additional, unrecited steps; it does not &amp;quot;reach into&amp;quot; each of the claimed steps to render every word and phrase therein open-ended.&amp;nbsp; This is particularly the case where the patentee has narrowly defined the claim term it now seeks to have broadened. &amp;nbsp;&lt;br /&gt;&lt;br /&gt;Turning to infringement, the Federal Circuit noted that the basis for the district court&amp;#39;s grant of summary judgment was not because the accused devices include vocabularies of only complete words, but rather that the accused devices do not contain vocabularies of only syllabic elements.&amp;nbsp; 				&lt;p&gt;In a decision last week, the &lt;a href=&quot;http://www.cafc.uscourts.gov/&quot; title=&quot;United States Court of Appeals for the Federal Circuit&quot;&gt;Federal Circuit&lt;/a&gt;  affirmed a district court&amp;#39;s finding of no infringement and invalidity for obviousness, and reversed the district court&amp;#39;s finding of unenforceability due to inequitable conduct.&lt;br /&gt;&lt;br /&gt;The Federal Circuit, citing &lt;a href=&quot;http://www.filewrapper.com/index.cfm/2007/4/30/Initial-thoughts-on-KSR-v-Teleflex&quot; title=&quot;KSR v. Teleflex&quot;&gt;&lt;em&gt;KSR&lt;/em&gt;&lt;/a&gt;, noted that an obviousness analysis can take account the inferences and creative steps that a person of ordinary skill in the art would employ, and held that there was a only small logical gap between the prior art and the claim at issue that could be closed by a person of ordinary skill in the art pursuing known options within his or her technical grasp and therefore the claim was obvious. &amp;nbsp;&lt;br /&gt;&lt;br /&gt;Regarding inequitable conduct, the court reaffirmed that intentionally misleading or false statements made in a petition to make special can lead to a finding of unenforceability, even if the statements do not relate to the patentability of the invention, as long as the false statement succeeds in obtaining expedited review of the application.&amp;nbsp; Here, however, the evidence was just as susceptible to the inference that intentional misrepresentations occurred as to the inference that the statements were either innocent, not misleading, or both.&amp;nbsp; As stated by the court:&amp;nbsp; &lt;/p&gt;&lt;blockquote&gt;Whenever evidence proffered to show either materiality or intent is susceptible of multiple reasonable inferences, a district court clearly errs in overlooking one inference in favor of another equally reasonable inference.&amp;nbsp; All reasonable inferences must be drawn from the evidence, and a judgment then rendered on the evidence as informed by the range of reasonable inferences.&lt;br /&gt;&lt;/blockquote&gt;Here, the district court clearly erred because it failed to give due weight to evidence of good faith that would call for inferences contrary to a finding of deceit.&amp;nbsp; As a result, the finding of inequitable conduct was reversed.&amp;nbsp; The district court also affirmed the finding of noninfringement.&lt;br /&gt;&lt;br /&gt;More detail of &lt;em&gt;Scanner Tech. 				&lt;p&gt;In a decision yesterday, the &lt;a href=&quot;http://www.cafc.uscourts.gov/&quot; title=&quot;United States Court of Appeals for the Federal Circuit&quot;&gt;Federal Circuit&lt;/a&gt;  affirmed a district court&amp;#39;s denial of the defendant&amp;#39;s motion to dismiss for lack of subject matter jurisdiction.&amp;nbsp; The court also denied the defendant&amp;#39;s post-verdict motion for judgment as a matter of law.&amp;nbsp; The defendant contended that because it shipped its allegedly infringing products &lt;a href=&quot;http://en.wikipedia.org/wiki/Free_On_Board&quot;&gt;f.o.b.&lt;/a&gt;  from its place of business in Canada, it did not sell or import the product in the United States, and thus there was no subject matter jurisdiction over the plaintiff&amp;#39;s infringement claims.&amp;nbsp; Alternatively, the defendant argued these same facts in support of its motion for judgment as a matter of law.&lt;br /&gt;&lt;br /&gt;The Federal Circuit noted that the district court had erred in considering the issue of whether allegedly infringing products had been sold or imported in the United States as an issue implicating the court&amp;#39;s subject matter jurisdiction.&amp;nbsp; Instead, this issue was simply an element of the claim to be proven that did not affect the court&amp;#39;s ability to hear the case.&amp;nbsp; On the merits, the Federal Circuit rejected the contention that because legal title to the products changed in Canada that there was not a &amp;quot;sale&amp;quot; in the United States as contemplated by &lt;a href=&quot;http://www.law.cornell.edu/uscode/html/uscode35/usc_sec_35_00000271----000-.html&quot;&gt;&amp;sect; 271(a)&lt;/a&gt;, given that the customer was in the United States and the products were shipped there.&amp;nbsp; As a result, the court affirmed the finding of infringement.&lt;br /&gt;&lt;br /&gt;More detail of &lt;em&gt;Litecubes, LLC v.
